URBALENTI™ is an independent online luxury fashion retailer based in New York City. By accessing or using www.urbalenti.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use this website.
1. ACCEPTANCE OF TERMS
By browsing, registering, or placing an order on this website, you confirm that you are at least 18 years of age and legally capable of entering into binding contracts. These Terms apply to all visitors, users, and customers.
By placing an order, you expressly acknowledge and accept our Shipping Policy and Returns & Refunds Policy, incorporated herein by reference.
2. USE OF THE WEBSITE
You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others. You may not use this site to transmit harmful, fraudulent, or unauthorized content, or to interfere with its operation.
3. ACCOUNT RESPONSIBILITIES
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
4. PRODUCT DESCRIPTIONS & PRICING
URBALENTI™ makes every effort to present accurate product descriptions, pricing, and imagery. Product images are for illustrative purposes only and do not constitute a contractual element.
We reserve the right to correct errors, update information, or cancel orders where pricing or product information is inaccurate. Prices are displayed in USD and may vary by market. All prices are generally listed exclusive of VAT, import duties, and taxes, which may apply per our Shipping Policy.
5. ORDER ACCEPTANCE & CANCELLATION
Placing an order constitutes an offer to purchase. The sale contract is concluded only upon URBALENTI™'s explicit acceptance via order confirmation email.
URBALENTI™ reserves the right to accept, decline, or cancel any order at its discretion — including cases of suspected fraud, stock unavailability, pricing errors, or violation of these Terms. You will be notified and refunded promptly if an order is cancelled by us.
No contract shall be considered effective unless the confirmation email is issued by URBALENTI™.
6. PAYMENT
All transactions are processed securely through third-party payment providers. By submitting payment, you represent that you are authorized to use the payment method provided. URBALENTI™ does not access or store full payment card details.
Initiating chargebacks or payment disputes without first contacting our Client Care team may result in immediate suspension or termination of your account. All subscription fees are final and non-refundable once service has been accessed.
7. SHIPPING & RETURNS
All orders are fulfilled from our logistics center in Milan, Italy and shipped worldwide via DHL Express.
Delivery timelines, import duties, customs responsibilities, shipping charges, and return conditions are governed by our Shipping Policy and Returns & Refunds Policy, incorporated herein by reference.
By placing an order, you acknowledge and agree that:
- Shipping charges are non-refundable once the order has been dispatched, except by law or URBALENTI™ error
- Customs duties, import taxes, VAT, and carrier charges are non-refundable under all circumstances, except by law
- Returns incur round-trip transportation, reimportation fees to Italy, and 4% processing fee, payable before a return label is issued
- You act as importer of record for returns to Italy and accept DDP terms
Delivery is considered complete once carrier tracking shows 'delivered' or equivalent. URBALENTI™ is not liable for packages lost, stolen, or refused after delivery confirmation, or for delays due to customs, incorrect shipping information, or buyer-side errors.
Returns: Must be requested within 14 days of delivery per our Returns & Refunds Policy. Unauthorized returns will be refused. Footwear, swimwear, and intimate apparel are Final Sale.
8. INTELLECTUAL PROPERTY
All content on this website — including text, images, logos, graphics, and design — is the property of URBALENTI™ or its licensors and is protected by applicable intellectual property laws. Unauthorized reproduction or use is strictly prohibited.
9. THIRD-PARTY LINKS
This website may contain links to third-party sites. URBALENTI™ is not responsible for the content, privacy practices, or accuracy of any external websites.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, URBALENTI™ shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of this website or any products purchased through it.
URBALENTI™ disclaims responsibility for payment fraud, inaccurate data provided by users, internet service failures, or customs delays. Our total liability shall not exceed the amount paid for the order in question.
Force Majeure: URBALENTI™ shall not be held liable for any failure or delay in fulfilling contractual obligations caused by events beyond its reasonable control, including but not limited to force majeure events, carrier strikes, customs seizures, or acts of government.
11. INDEMNIFICATION
You agree to indemnify and hold harmless URBALENTI™, its officers, employees, and partners from any claims, damages, or expenses arising from your violation of these Terms, misuse of this website, or failure to comply with import regulations.
12. PRIVACY
Your use of this website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The processing of personal data is governed by our Privacy Policy available at /privacy-policy.
13. GOVERNING LAW
These Terms are governed by the laws of the State of New York, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New York County, New York. Consumer disputes shall be resolved in your local jurisdiction within the United States where applicable by law.
14. AI CHATBOT DISCLAIMER
URBALENTI™ may provide access to an AI-powered chatbot for customer assistance. Information provided by the AI Agent is for general informational purposes only and may be incomplete or inaccurate. You agree not to rely on AI-generated information for commercial or legal decisions. Only written correspondence from URBALENTI™ official email domains shall be considered legally binding.
15. MODIFICATIONS
URBALENTI™ reserves the right to update these Terms at any time. Changes will be posted on this page with an updated date. The Terms in effect at the time of placing an order shall apply to that order. Continued use of the website after changes constitutes acceptance of the revised Terms.
16. SEVERABILITY
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
